Dr Nakarawa files judicial review application against his removal

Former Fiji Corrections Service Commissioner Dr Jalesi Nakarawa has filed an application in the High Court seeking judicial review of the decision that led to his removal from office.

In the application, Dr Nakarawa is asking the court to quash the President’s decision of removing him as Commissioner and to reinstate him to the position with compensation for lost salary and benefits.

He is also seeking a declaration that the decision was unlawful, null and void.

Dr Nakarawa argues that the tribunal exceeded its jurisdiction by considering internal operational matters within the Fiji Corrections Service, including recruitment decisions, staffing changes and implementation of the Job Evaluation Exercise.

He maintains these were administrative decisions made in good faith under his statutory powers as Commissioner.

The application names the President of the Republic of Fiji, the Constitutional Offices Commission and the Attorney-General as respondents.

Dr Nakarawa is represented by Defence Counsel Devanesh Sharma and Gul Fatima.

Judge, Justice Vishwa Dutt Sharma has given both parties 21 days to file affidavid in response and reply.

The matter has been adjourned to the 10th of August for the hearing date to be set.
