The admissibility of DNA evidence will be at the centre of the vordire proceedings in the case against Isaia Ledua.
Ledua is accused of breaking into the Republic of Fiji Military Forces armoury at Queen Elizabeth Barracks in April this year.
Ledua faces one count each of aggravated burglary and damaging property.
He appeared before High Court Judge Justice Dane Tuiqereqere this morning.
The court set aside two days for a voir dire hearing in April next year to determine whether the DNA evidence can be admitted at trial.
The defence is challenging the circumstances in which the DNA evidence was obtained.
Ledua’s lawyer Jerry Dinati claims his client was not informed about his rights when investigators conducted a swab for his DNA.
The court heard that the issue surrounding the DNA evidence will need to be determined before the substantive trial proceeds.
The prosecution has been directed to provide further disclosure this week, while the parties are expected to complete the necessary pre-trial processes ahead of the hearing.
The matter has been adjourned to next Thursday for a pre-trial conference.
