The Office of the Director of Public Prosecutions has terminated proceedings against Keni Salawai and Jope Seniloli, who were charged with the murder of Police Constable Peniasi Racagi in Lami.
This comes after DPP Counsel Sadaf Shameen informed the court that they had filed a nolle prosequi this morning.
High Court Judge Justice Daniel Goundar told Salawai and Seniloli that under the law, the DPP is not required to give any reasons for its decision, and under those circumstances, he was formally terminating the proceedings.
Justice Goundar told the men that they were free to go, but that being discharged means the same charges could still be brought against them in the future.
Meanwhile, the Fiji Police Force has stated that they will make comments once the file is returned from ODPP.
They say due process was followed on the sanctioning and laying of charges with ODPP.
Police say the withdrawal of charge whilst in the judical process is ODPP’ s call, and the investigations into two avenues of the officer’s death and police involvement continues.
