The Acting Director of Public Prosecutions John Rabuku says the Attorney General and the President of the Fiji Law Society’s calling for his resignation publicly is an attempt to usurp the Judicial Services Commission’s role in this saga.

Rabuku says the Commission knows its role and has already worked out with him the way forward after two meetings this week.

He says there is a process in place and that process needs to be followed to ensure that the Office of the DPP continues to function at the level it has been functioning under his leadership and his exit is as smooth as possible for the staff and everyone.

When asked if he has received any communication from the Cabinet or the Commission to step down from his role as DPP, Rabuku adds that the Cabinet does not and will not communicate with him as it is not their role.

Rabuku says he has discussed with the Commission as to how and when he will exit the Office.

He says that has already been decided and the Commission will announce that.

Rabuku says the Supreme Court is the highest Court of the land and it has passed an opinion, however, whether or not he agrees with it is irrelevant but that opinion must be adhered to.

He also stressed that that opinion is not an order for him to vacate his office which is why it was important for him to wait for the Commission to execute the proper processes that have now been put in place.

Rabuku says it is important for lawyers to read and understand what the Supreme Court opinion is in its entirety.

He says it is also important for senior lawyers to know their role in the Justice system.
