Littering Penalty Set To Rise From $40 To $200

The fixed penalty for littering will increase from $40 to $200 from September 1, 2026.

Cabinet has endorsed the Litter Offence (Fixed Penalty Notice) (Amendment) Regulations 2026, aimed at strengthening enforcement and creating a more consistent approach to littering offences nationwide.

The changes address gaps in enforcement, outdated penalties and procedural issues under the existing framework.

They will also provide a standardised system for Litter Prevention Officers, municipal councils and other authorised enforcement officers.

The new regulations include training for enforcement personnel, improved administrative processes, digital payment options for fixed penalty notices and greater public awareness.

The Ministry of Environment and Climate Change and other enforcement agencies will undertake preparations before the new regulations take effect on September 1.
