The Suva High Court has raised concerns over delays in key evidence disclosures in the case involving two men charged over the death of Police Constable Peniasi Racagi.
Judge, Justice Daniel Goundar questioned why police had yet to provide a postmortem report despite the seriousness of the matter.
Forty-two-year-old Keni Salawai and 20-year-old Jope Seniloli are accused of murder in this case.
The two men, along with a third individual , are alleged to have between the 21st and 22nd of February aided and abetted in causing injuries to Police Constable Racagi, resulting in his death.
Constable Racagi’s body was found near the beach behind the Lami Oceania Wesley Church in the early hours of the 22nd.
The State informed the court that several important documents remain outstanding, including the postmortem report, and records of interview.
Justice Goundar expressed concern over the delay, noting the case involves the death of a police officer and questioning why crucial evidence had not yet been produced.
State Counsel told the court DNA samples had been sent to New Zealand for forensic analysis and results are still pending.
Defence counsel also raised concerns about delays in receiving disclosures, saying the defence has been waiting more than two months for certain interview records and video material.
The matter has been adjourned to the 22nd of this month for the State to file full information and disclosures before the case proceeds further
