Defence Seeks Additional Disclosures in FBC Vehicle Procurement Case

The defence lawyers representing former Fijian Broadcasting Corporation CEO Riyaz Sayed-Khaiyum and current Chief Financial Officer Vimlesh Sagar have raised concerns over outstanding disclosures, saying further documents are needed to prepare their case.

The matter was called before Magistrate Joseph Daurewa this morning.

Sayed-Khaiyum’s lawyer Gul Fatima informed the court that they had written to FICAC in November last year, requesting additional information, particularly documents relating to the alleged loss connected to the charges.

The court heard the defence received a two-page response from FICAC; however, they argued it did not provide a comprehensive explanation and only referred them to documents that were already part of the disclosures.

Sagar’s lawyer Ritesh Singh also raised similar concerns and adds that the addition disclosures is critical to ensure a fair trial.

The defence submitted that the documents provided do not address key issues they had raised, including how the alleged loss was calculated and who made certain decisions.

Singh argued that without the requested information, they may not be in a position to properly defend their clients and referred to Section 14 of the Constitution, which provides an accused person the right to receive information needed for their defence.

Fatima also indicated that they may consider filing an application under the Criminal Procedure Act if the requested information is not provided.

FICAC Lawyer Josann Pene confirmed proposed agreed facts and documents have been provided to both defence counsel.

She adds the concerns raised by defence are trial issues.

Sayed-Khaiyum and Sagar are charged in relation to the tender and procurement of a 3.0L Volkswagen Touareg vehicle valued at $207,470.

The matter has been adjourned to the 9th of next month for a pre-trial conference.
